This Consent & Disclaimer Policy governs your use of the Hopsita platform (“Hopsita,” “we,” “our,” or “us”) and your interaction with all digital properties, including our website, mobile applications, and third-party services integrated within the platform.
By accessing or using Hopsita, you acknowledge and expressly consent to the terms outlined in this policy and agree to hold Hopsita harmless under the disclaimers listed below.
1. Informed Consent for Platform Use
By using Hopsita, you confirm and consent that:
· You are at least 18 years of age or the legal age of majority in your jurisdiction.
· You understand that Hopsita is a technology-enabled marketplace that connects healthcare professionals (e.g., medical students, travel nurses, residents) with independently operated host housing, and that Hopsita does not own or manage any listed properties.
· You voluntarily provide personal and professional data (including identity documents, healthcare affiliation details, or payment info) for the purposes of verification, booking, or compliance.
· You consent to communications from Hopsita (e.g., emails, texts, or push notifications) related to platform operations, security, support, promotions, and booking confirmations.
2. Consent to Data Handling
You agree and consent that:
· Your data may be stored securely, in compliance with our Privacy Policy, and processed through third-party tools such as payment processors (Stripe), ID verification APIs, analytics platforms, or email systems.
· Hopsita may retain transactional data, booking history, and identity verification documents as part of fraud prevention, dispute resolution, or legal compliance.
· Hopsita does not sell, rent, or share your data with advertisers or third parties unrelated to platform functionality.
· You have the right to access, rectify, or delete your data by emailing [email protected].
3. Disclaimer of Liability
To the maximum extent permitted by law:
· Hopsita does not guarantee the availability, cleanliness, legality, safety, or accuracy of any listing posted by a host. Hosts are independently responsible for complying with local housing, health, safety, insurance, and zoning laws.
· Guests use the platform at their own discretion and risk. Hopsita is not liable for damages, injury, theft, harassment, discrimination, illness, property disputes, or personal conflict arising from off-platform interactions.
· Hopsita is not responsible for booking errors caused by incorrect information, payment failure, host cancellation, guest no-shows, or internet outages.
· Hopsita is not liable for any losses incurred as a result of force majeure events (e.g., war, pandemic, natural disaster, government restrictions, or acts of God).
4. Financial & Transactional Disclaimers
· All bookings processed via Stripe Connect are subject to Stripe’s service terms and fraud monitoring systems.
· Hopsita does not store full credit/debit card numbers or passwords on its servers.
· Disputes between users (host ↔ guest) involving cancellations, refund requests, or damages are first to be resolved through our internal support team. In cases where arbitration is needed, both parties must submit documentation and agree to mediation facilitated by Hopsita.
· Hopsita is not liable for bank delays, chargebacks, or tax implications resulting from booking payments or platform commissions.
5. Consent to Third-Party Services
By using Hopsita, you also agree to the terms and policies of third-party services integrated into the platform, which may include but are not limited to:
· Stripe (payments & payouts)
· Persona, Stripe Identity, or similar (ID verification)
· Google Maps (location services)
· Firebase, AWS, or other cloud-based infrastructure providers
These services may collect data, perform security checks, or log usage based on their own privacy and compliance terms.
6. Medical & Professional Disclaimer
Hopsita does not provide medical housing certifications, nor does it serve as a housing authority, academic institution, or medical residency program. It is solely a technology platform. Any claims of "hospital-approved" or "resident-preferred" are made by the hosts or users and not endorsed by Hopsita unless explicitly stated.
Medical advice, recommendations, or institutional affiliations made by other users are not verified or validated by Hopsita.
7. User Responsibility & Consent to Platform Terms
By using Hopsita, you accept full responsibility for:
· Conducting due diligence before booking or hosting
· Following all applicable local laws and regulations in your jurisdiction
· Using the platform ethically and lawfully
· Keeping your login credentials confidential and secure
· Reporting any violations, fraud, or suspicious behavior to [email protected]
8. Indemnification Clause
You agree to indemnify, defend, and hold harmless Hopsita, its founders, team members, investors, affiliates, and service providers from and against any and all claims, losses, damages, expenses, and liabilities (including legal fees) arising from:
· Your use or misuse of the platform
· Your breach of this Consent & Disclaimer Policy
· Any violation of third-party rights, including intellectual property or privacy
· Any disputes arising from your interactions with hosts, guests, or third-party services
9. Changes to This Policy
Hopsita reserves the right to update or modify this policy at any time, with or without notice. Any changes will be posted on this page with an updated effective date. Continued use of the platform after such changes constitutes your consent to the revised terms.
